Dear Recording Secretary:

As a member in good standing of the Laborer's International Union of North America, I, Mike Blissmer, am preferring charges against Mike Campbell and Frank Bova in accordance with Article XXIII of the Constitution of the Laborers' International Union of North America as well as Article III of the Uniform Local Union Constitution of the Laborers' International Union of North America together with Article XII of the Uniform District Counsil Constitution.

On September 29, 1999, field representative Mike Campbell called my job superintendent, Bob Loiacano, and told him I had been fighting of the job. Mr. Campbell told Mr. Loiacano that he expected me to be disciplined for fighting. Disciplinary action for fighting on the job is immediate dismissal. Bob Loiacano knew nothing of the incident. Mr. Loiacano investigated the incident and my fellow brothers stood by me and told the investigators that there was no incident. Bob Loiacano informed Mike Campbell that the investigation turned up nothing. Mike Campbell then threatened Bob Loiacano by saying that if he did not discipline me, if other things happened on the job, he could not discipline others either.

It is my position that a union official trying to get union members fired is against everything our union stands for and further I think that this incident was politically motivated. As a member of this union, I have the potential to be a candidate for and hold an office or position in the local union. I feel this incident is politically motivated.

Specifically, under Article II of the Uniform Local Union Constitution, Section I, Objects: each local union is charged with the responsibility to (c) conduct it's affairs in a manner which would most tend to enhance, conserve and protect the welfare and interests of the International Union, it's affiliates and members; further that the union is charged with the responsibility to perform or carry out it's objects and functions in accordance with the provisions of this constitution, the International Union Constitution and the Uniform District Counsel Constitution as herein after provided.

That in conclusion, this behavior on the part of both Mr. Campbell and Mr.Bova is not conduct in a manner which would tend to enhance, conserve and protect the welfare and interests of myself, Mike Blissmer, a member of the Laborer's International Union of North America.

As business manager, Frank Bova, pursuant to Uniform Local Union Constitution Article IV shall be in charge of, direct and supervise the activities of field representatives such as Mike Campbell and it shall be his duty to see to it that the affairs and business of the local union are being properly conducted in accordance with the constitution. That Mr. Bova is then vicariously liable for the actions of Mr. Campbell as stated above.

In conclusion, I think that Mr. Campbell should be fined, suspended from his job and expelled from the union and further that Frank Bova should be fined and further disciplined as the trial board sees fit.
